Bishkek City Hall Warns About Speculation and False Information Related to Master Plan 2050
Currently, the draft of the Bishkek Master Plan 2050 has been submitted for public hearings.
In recent weeks, cases of land price speculation for agricultural plots have been recorded, as well as the spread of false information regarding the goals and objectives of the Master Plan 2050.
The City Hall reminds that the Master Plan project is still under discussion, and no decisions have yet been made regarding the redistribution of land, changes in land categories, or development of territories.
The intended use of land plots is carried out in accordance with the requirements of the Land Legislation of the Kyrgyz Republic.
In particular, when constructing multi-storey residential buildings or other facilities on agricultural land, changing the designated purpose of the land requires a formal change in land category, in accordance with the Land Legislation and the Regulation “On the Procedure for the Conversion (Transformation) of Land Plots,” approved by the Decree of the Cabinet of Ministers of the Kyrgyz Republic on November 4, 2024, No. 665.
Recently, a social media post appeared advertising the sale of 17 hectares of land in the northwestern part of the capital for the construction of 4- to 8-story residential buildings at a price of USD 3,000 per 100 square meters.
Regarding this land plot, the City Hall, as the authorized territorial body for land transformation issues, has not received any materials or applications for changing the land category. Accordingly, the land category remains unchanged, and construction without proper reclassification is prohibited.
Furthermore, the new Master Plan referenced in the advertisement has not yet entered into legal force and is not officially approved. Therefore, using the draft Master Plan for personal profit while it is still under public discussion may result in legal liability imposed by the competent authorities.
According to paragraph 3 of Article 13 of the Land Code of the Kyrgyz Republic, except for agricultural lands, changes in the type of land within a single category can be carried out without formal conversion from one type to another. Changes in land type within settlements are carried out based on urban planning documents, without conversion.
Even after the Master Plan is officially approved, using agricultural land for other purposes will still require a formal change in land category. This must be done in accordance with the above-mentioned Regulation and through the proper procedural steps.
